Florida laws and regulations for memory care facilities

In Florida, memory care is considered a type of assisted living and is licensed by Florida’s Bureau of Health Facilities Regulation. Communities that offer memory care need to meet the assisted living requirements in addition to memory care requirements.

Specific requirements for memory care communities in Florida include the following:[01]

  • 24-hour staffing
  • Awake staff member at all times if the community is home to 17 or more residents
  • Four hours of continuing education for care staff per year
  • Activities designed for seniors with cognitive impairment
  • An environment that is safe for residents

Communities that provide memory care are also required to disclose which features in the community are suitable for seniors with dementia.

Memory care facilities go through an initial inspection to get their license. After that, inspections occur every two years and are unannounced.[01] The Florida Agency for Health Care Administration has a public record search where you can look for communities by name to see if they’ve had any violations.

During inspections, if a community is found deficient in any area, the community will receive a statement of deficiencies. This designation will be noted in the public record search. Communities have the option to appeal these decisions, so you may want to request more details about any community you’re considering.
